However, an insuffisiant application, which does not meet the requirements in order to obtain a filing date is generally irregular, and to avoid rejection and get the admissibility of the application, it must be corrected while respecting the rule of prohibition of adding information in the description.???
The conditions necessary for obtaining a filing date
The date of filing a first application is of paramount importance since it determines the documents that may oppose the patenting of the invention and serves as a starting point for the priority period for extensions abroad.
In order to obtain a filing date, it is always necessary for the applicant and the nature of the request to be identified, as well as other conditions that affect the form and content of the application, depending on its nature:
A French patent application must be written French and include a description and at least one claim.
A European patent application may be written in any language and must include a description that can be replaced by a reference to a previously filed application.???
An international patent application may be written in any language and must include a description that can be replaced by a reference to a previously filed application, and at least one claim.???
