Patent
A patent is a property which allows the owner to prohibit and to authorize the conditions under which third parties exploit the invention. It is published and issued by a national (INPI in France) or regional (OEB in Europe) authority following the filing of a patent application, provided that the application and the invention meets the requirements, including patentability.
The effects of a patent are limited by time (generally 20 years after filing) and in location (the territory of the State depends on the authority that issued it). These effects may also be reduced or revoked by a court, particularly after a counterclaim for defense in an infringement action. They can also stop in case of rejection upon examination or failure to pay annual fees for maintenance.
